Fireworks: The issue of misuse
The annual fireworks season has once again come to a close, leaving behind a mixed bag of experiences. While many enjoy the spectacle, others are left with feelings of distress and anxiety. It’s important to address some crucial facts about fireworks, even if they don’t align with everyone’s expectations.
The Misuse of Fireworks: A Persistent Issue
The misuse of fireworks is a serious offence under the Firework Regulations 2004, punishable by an unlimited fine (up to £5,000 in Scotland) and/or up to six months imprisonment. We categorise misuse into two primary areas: unintended misuse and wilful misuse.
Unintended Misuse: A Matter of Education
Unintended misuse stems primarily from a lack of knowledge. This includes ignorance of the law, disregard for safety instructions, and a lack of consideration for the well-being of others.
However, education can effectively address these issues. By providing clear and accurate information to the public about permitted use times, safe handling practices, and the importance of considerate behaviour, we can empower individuals to use fireworks responsibly.
The success of this approach is evident from the experience during the pandemic. When public displays were cancelled, a significant number of people turned to at-home fireworks displays. Despite this increase, accident rates did not rise, demonstrating that the public largely grasped the message of safe and responsible fireworks use.
Wilful Misuse: A Deliberate Act of Disregard
Wilful misuse, on the other hand, involves deliberate and intentional disregard for the law and the safety of others. This includes setting off fireworks in public spaces, using them as weapons, or igniting them outside of permitted hours. These actions are not only illegal but also pose a significant risk to public safety and well-being. Greater restrictions will have no impact on this, however greater enforcement of the existing legislation will. The widely publicised convictions of those who wilfully misuse fireworks will send a clear message that it will not be tolerated.
Conclusion
While the enjoyment of fireworks is a legitimate pastime for many, it is crucial to acknowledge and address the issue of misuse. By promoting education and raising awareness about safe and responsible use, we can minimise the negative impacts of fireworks and ensure a safer and more enjoyable experience for the millions who enjoy them in a safe, responsible and considerate manner each year.
